Fair use in film noir
This is an audio excerpt from a commercial motion picture's musical score and accompanying soundtrack film. Its inclusion here is claimed as fair use because:
- It illustrates an educational article that discusses the excerpted score and its significance as a "wonderful update of film noir music traditions". Among the score's three composers, "Debney's pieces ... are the closest to traditional noir film music. (Source: Template:Cite web)
- It is a low-bit-rate sample of less than 30 seconds from a significantly longer musical track and score, and far longer motion picture, and could not be used as a substitute for the original commercial recording;
- It is not replaceable with a free-use sample of comparable educational value; and
- It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.
